These Terms of Use (“Terms”) govern your access to and use of www.ovhmed.com and related online services provided by Optima Vida Healthcare, LLC (“Optima Vida Healthcare,” “OVH,” “we,” “us,” or “our”).

By accessing or using our website, you agree to these Terms. If you do not agree, please do not use the website.

1. Healthcare Services

Optima Vida Healthcare provides healthcare services through telehealth and, where available, other methods of care.

Information presented on our public website is provided for general informational and educational purposes. Website content alone does not constitute individualized medical advice, diagnosis, or treatment.

A clinician-patient relationship is established only through the appropriate clinical process and as permitted by applicable law.

Submitting an intake form, requesting a service, scheduling an appointment, or making a payment does not guarantee that you will receive a particular treatment, medication, prescription, laboratory order, diagnosis, or other healthcare service.

Treatment decisions are made independently by a licensed healthcare professional based on clinical judgment, your individual circumstances, applicable standards of care, and applicable law.

2. Prescriptions Are Not Guaranteed

Optima Vida Healthcare does not guarantee that any medication will be prescribed.

If prescription treatment is requested or discussed, a licensed healthcare professional will determine whether treatment is medically appropriate after completing the evaluation required for the particular service and jurisdiction.

The clinician may:

  • Recommend a different treatment;

  • Request additional medical information;

  • Require laboratory testing;

  • Require a video or other synchronous visit;

  • Recommend evaluation by another healthcare professional;

  • Decline to prescribe a requested medication; or

  • Determine that telehealth treatment is not appropriate.

Payment for an evaluation or healthcare service does not guarantee issuance of a prescription.

3. Telehealth and Geographic Eligibility

Healthcare services are available only in jurisdictions where Optima Vida Healthcare and the treating clinician are legally permitted to provide the applicable service.

Availability may vary by state, patient location, service, medication, and applicable law.

You are responsible for accurately reporting your physical location at the time healthcare services are provided.

Certain services, including services involving controlled substances, may have additional eligibility requirements, geographic restrictions, in-person examination requirements, or other limitations imposed by federal or state law.

Optima Vida Healthcare may decline or discontinue a service when applicable legal, licensing, clinical, or regulatory requirements cannot be satisfied.

4. Emergencies

OPTIMA VIDA HEALTHCARE'S WEBSITE AND TELEHEALTH SERVICES ARE NOT INTENDED FOR MEDICAL EMERGENCIES.

If you believe you are experiencing a medical emergency, call 911 or seek immediate evaluation at an appropriate emergency medical facility.

Do not use website forms, email, patient messaging, or routine telehealth services to request emergency medical assistance.

5. Accuracy of Information You Provide

You agree to provide complete, current, and accurate information when using our services.

This includes information concerning your:

  • Identity;

  • Physical location;

  • Medical history;

  • Medications and supplements;

  • Allergies;

  • Symptoms;

  • Diagnoses;

  • Pregnancy or reproductive status when clinically relevant;

  • Laboratory results;

  • Other healthcare providers; and

  • Other information reasonably requested for your care.

Withholding or providing inaccurate medical information may make telehealth treatment unsafe and may result in delay, modification, or discontinuation of services.

6. Patient Accounts and Security

Certain services may require use of a patient portal or other account.

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

Notify us promptly if you believe your account or credentials have been compromised.

You may not access another person's account without appropriate authorization.

7. Pharmacies, Laboratories, and Other Third Parties

Optima Vida Healthcare may work with independent pharmacies, laboratories, technology providers, payment processors, and other third parties.

Unless expressly stated otherwise, these entities are separate organizations and may maintain their own terms, policies, pricing, processing times, and privacy practices.

When a prescription is medically appropriate, the treating clinician determines whether to prescribe. A pharmacy is separately responsible for determining whether it can legally and appropriately dispense a prescription.

Medication availability, pharmacy processing, shipping, laboratory turnaround times, insurance coverage, and third-party services are not guaranteed by Optima Vida Healthcare.

8. Compounded Medications

When clinically appropriate and legally permitted, a clinician may prescribe a compounded medication.

Compounded medications are not FDA-approved. The FDA does not review compounded medications for safety, effectiveness, or quality before they are marketed in the same manner that it reviews FDA-approved drugs.

Whether a compounded medication is appropriate for an individual patient is determined by the treating clinician based on clinical circumstances and applicable law.

Availability of compounded medications may change because of pharmacy availability, federal or state law, regulatory requirements, drug-shortage status, or other circumstances.

9. Fees and Payments

You agree to pay applicable fees disclosed to you before purchasing or receiving services.

Fees for medical evaluation or other professional services may be separate from costs associated with medications, pharmacies, laboratories, or other third-party products and services.

Payment for healthcare services does not guarantee a particular clinical outcome, treatment, medication, or prescription.

Additional terms may apply to recurring payments or subscription services. When applicable, those terms will be disclosed before authorization and are further addressed in our Recurring Payment Policy.

10. Insurance

Unless specifically indicated for a particular service, you should not assume that Optima Vida Healthcare services, medications, laboratory testing, or other costs will be covered by your health insurance.

Coverage and reimbursement decisions are made by the applicable health plan or payer.

You are responsible for understanding your insurance benefits and for amounts not covered by insurance, subject to applicable law and any specific agreement with Optima Vida Healthcare.

11. Website Information

We make reasonable efforts to provide useful and accurate information, but medical knowledge, laws, regulations, medication availability, pricing, and healthcare requirements change over time.

We do not guarantee that every piece of general website information will always be complete, current, or applicable to your individual circumstances.

Website content should not be used as a substitute for individualized evaluation by a qualified healthcare professional.

12. Privacy

Your use of the website is also subject to our Privacy Policy.

Our use and disclosure of protected health information associated with healthcare services is described in our Notice of Privacy Practices.

Telehealth services may also be subject to additional notices and consents provided during the patient intake or treatment process.

13. Acceptable Use

You agree not to:

  • Use the website for unlawful or fraudulent purposes;

  • Attempt to gain unauthorized access to systems, accounts, or data;

  • Interfere with the security or operation of the website;

  • Introduce malicious software or harmful code;

  • Impersonate another person;

  • Submit false or misleading information;

14. Intellectual Property

Healthcare services remain subject to the laws and professional requirements applicable to the patient's location and the treating clinician.
